Scope :

AppBrick ( “AppBrick” ) Statement on Privacy and Security of Information ("Policy"). The following Policy explains our information collection, use and disclosure practices. This Policy applies to all the information collected from you during use of our Web site, http://www.AppBrick.com (the "Site"). By using this Site, you signify your acceptance of this Policy. We hope that this will help you make an informed decision about sharing personal information with us.

Information Collected:

Personally Identifiable Information Collected by AppBrick: When you register with the AppBrick service, our registration form may require you to give us certain information such as your name, email address, and zip code. AppBrick will also collect other information you volunteer to us through use of our service that may be used to identify you, such as your cell phone number. We refer to this information as "Personally Identifiable Information." You always may choose not to provide such Personally Identifiable Information; however, this may limit our ability to provide you with a specific service or particular content. We may also collect demographic and other data, which may include Personally Identifiable Information, generally through surveys and forms in which you may or may not choose to participate. If you place an order for goods on AppBrick, you may be required to enter your credit card number and information, as well as your shipping address and/or other contact information.

From time to time, AppBrick may also have special offers or promotions that are sponsored by a Business Partner. AppBrick may also offer goods or services for purchase available by our Advertisers. If you purchase goods or services offered through AppBrick by a Business Partner, then you may be required to submit Personally Identifiable Information in order to complete the transaction and AppBrick may provide Personally Identifiable Information about you to such Business Partner for that purpose. If you elect to receive information from a Business Partner, or if you provide information to obtain a product or service, AppBrick may pass your information to such Business Partner. When you visit AppBrick your URL, IP address, browser type and language and the date and time of your request are recorded automatically. AppBrick may also use personal information for auditing, research and analysis purposes.

My Account Page:

Personally Identifiable Information Collected by AppBrick's Business Partners: AppBrick works with third-party advertising companies, sponsors and other companies with whom we do business ("Business Partners") to place advertising on our Site and in email communications sent to our registered users and to recipients of songs, messages, and other communications related to the AppBrick service or to offer products and services on our Site. Our Business Partners may read or set cookies on your hard drive, use pixel tags, track which ads you have viewed, or collect other information about you. Cookies and pixel tags are discussed further below.

In some cases, we may enter into a promotional relationship with a Business Partner in which we prominently display their brand name or trademarks on pages that appear the same as or very similar to the pages of the AppBrick service. These pages are known as "Co-Branded Pages" and these particular Business Partners are known as "Co-Branded Business Partners." If the page on which you submit information is a Co-Branded Page, or was accessed by clicking on a link on a Co-Branded Page, then Personally Identifiable Information about you may be collected by both AppBrick and the Co-Branded Business Partner. Personally Identifiable Information collected directly by a Business Partner will be governed by the Business Partner’s privacy policy, not this Site’s Policy.

My Address Book and My Phone Book Information:

In order to send messages to your friends / acquaintances/ family through the AppBrick service, we require that you submit to AppBrick current, valid email addresses and phone numbers for guests. When you send messages to your friends/acquaintances/ family through our service (e.g., Play a song or Broadcast a message), we collect and retain the email addresses or other pertinent contact information of those persons to whom you send the message. If you receive such a message as a recipient and choose to use the Site, we may request additional information and the treatment of information collected from you as a guest will be governed by this Policy. For example, if you or your friends choose to use certain services offered through our Site, you or your friends may be asked to submit to AppBrick an email address, phone number and/or other contact information so that we may provide you with such service. Please see “Use of My AddressBook and My PhoneBook Information” below for more information.

Phone Communications:

AppBrick wants to optimize your experience by ensuring that the most relevant information, promotions and offers are displayed to you while using the Site. A common manner in which to do this is by using cookies or similar technologies to gather information. Cookies are strings of text and numbers that our server places on your hard drive that can identify your computer to us when you visit our Site, and which may be correlated with Personally Identifiable Information about you in our log files. In the event a location, like a zip code, is not available in your profile or you have not searched in a location on AppBrick, we will cookie your location from your last AppBrick invitation. Although cookies allow you to visit the Site more efficiently, you may elect to disengage them by changing your browser properties. Each browser is different, so please review your browser properties to determine how to disengage cookies.

IP Address:

When you visit our Site, we log standard information such as your IP address, which is a number that can be used to identify your location and Internet Service Provider, along with the URL from which you came to our Site and the URLs visited on our Site. A URL is the full address of a Web site page, which may or may not contain some Personally Identifiable Information about the person who is viewing it. We may track which Web site you visited before arriving at the Site and the Web site you link to when you leave the Site. We may also keep a record of which pages of the Site you visit, and how long you spend on each page.

Pixel Tags:

AppBrick uses pixel tags to gather information about the emails we send to our registered users and to recipients of messages. Pixel tags are tiny graphic files, not visible to the human eye, that are included in our HTML-encoded email messages. When such a message is opened in an HTML-capable email program, the recipient's computer will access our server to retrieve the pixel tag file, allowing us to record and store, along with your email address, the date and time the recipient viewed the invite or reminder, that the recipient's email program is capable of receiving HTML-encoded email, and other standard logging information. The pixel tag also may see or read cookies. For more information about cookies and how to disable their use, see the section below on "Use of Cookies."

Use of Information:

Use of Personally Identifiable Information by AppBrick: We use the Personally Identifiable Information collected on the Site to provide you with personalized service, schedule events for you, contact the people on your AppBrick Address Book and Phone Book list, contact you in connection with your transactions, postings and other activities on the Site, forward to you messages from other users, communicate with you about events or activities in your area, process e-commerce transactions, ensure the smooth operation of the Site, and improve the Site and AppBrick service. We may also use your Personally Identifiable information to contact you to respond to a request from you. When we send you a communication, it may contain commercial messages, such as banner ads and special offers. We or our third party service provider may use cell phone numbers provided to us to send you mobile alerts with information about parties to which you are invited, to send birthday reminders and commercial messages from select advertisers. Each communication (other than mobile alerts) we send to you or which is sent on our behalf, other than communications sent to you for the sole purpose of addressing a technical or operational issue regarding the AppBrick service, will give you the opportunity to opt-out of receiving further communications from us. With respect to mobile alerts, you may request not to receive further mobile alerts from us at any time by following the opt-out instructions on this Site. In addition, we use Personally Identifiable Information about you to help us provide you with personalized content, advertising, and commercial messages (collectively, "Content").

AppBrick may correlate or match registered users' information, including Personally Identifiable Information, with information held by our Business Partners to target ads or otherwise improve the effectiveness of our service.

Use of Personally Identifiable Information by Other Users:

Users will be able to view the Personally Identifiable Information that you provide on your My account Page, unless you choose to hide such information. You also may choose to have the Personally Identifiable Information you supply on your My Info Page viewable to AppBrick users in general. In addition, other users may choose to email you. However, to ensure your privacy, AppBrick will not display or give out your email address or any other contact information to other users except as otherwise described in this Policy. We have developed a Message Center that uses a "double-blind" email system, which hides the email addresses of both the sender and recipient of email messages to protect the privacy of both the sender and receiver. When using the Message Center , it is up to you to choose when you are comfortable disclosing your email address, or any other contact information, to others through private communications.

Use of Personally Identifiable Information by AppBrick's Business Partners:
Information about your visit to this Site, such as number of times you have viewed an ad, may be used by AppBrick’s Business Partners to serve advertising to you on this Site.

When a Business Partner collects Personally Identifiable Information directly from you, the collection and use of such Personally Identifiable Information will be governed by the Business Partner’s privacy policies. AppBrick is not responsible for any Business Partners’ use of Personally Identifiable Information or their privacy policies and procedures on any Web site. You will need to contact the Business Partner to instruct them directly regarding your preferences for their use of Personally Identifiable Information about you. From time to time, AppBrick or a partner may sponsor a promotion, sweepstake or contest on AppBrick. Users may be asked to provide personal information including name, email address or home address or to answer questions in order to participate. We may transfer personal information to certain ad partners that you have explicitly requested to receive information from. It will be clear at the point of collection who is collecting the personal information and whose privacy statement will apply.

Use of My Address Book and My Phone Book Information:

Email addresses of the recipients of a common message may be visible to all the recipients of the message. If you use our Reminders service, we use the information you provide in your Reminders to send it to you and others to whom you have requested it be sent. Other than as described in this Policy we will not intentionally sell or otherwise disclose My Address Book and My Phone Book information you submit to any third party.

AppBrick members can invite other people to join the service by sending invitation emails via our automated invitation system. AppBrick stores the email addresses that members provide so that the respondents may be added to the contact's list of the member sending the invitations, and also to send reminders of the invitations. AppBrick does not sell these email addresses or use them to send any other communication besides invitations, invitation reminders. Recipients of invitations from AppBrick may contact AppBrick to request the removal of their information from our database.

AppBrick may also choose to send invitations and other communications to email addresses stored in the My Address Book section of various members. You may prevent AppBrick email invitations and other messages from being sent to any email address you control by contacting us in writing to AppBrick.Services@AppBrick.com

Use of Cookies:

We use cookies to deliver content specific to your interests, among other purposes. You can always choose not to accept cookies through your browser's preference options, but you may not be able to use some of our services if you do not accept cookies.

As described in more detail above, Business Partners display ads through our service. These ads may contain cookies. While we use cookies in other parts of our Site, cookies received with banner ads are collected by our Business Partners, and we do not have access to this information. Likewise, some of our Business Partners may use cookies. We do not control their use of cookies nor have access to the information contained in or related to those cookies. Please contact our Business Partners directly for more information about their privacy practices.

Use of IP Addresses:

We use your IP Address to help diagnose problems with our server, and to administer the Site and otherwise provide our service to you. IP addresses may be disclosed to Business Partners if AppBrick believes in good faith that the law or legal process requires it, or to protect the rights or property of AppBrick or others. In addition, our Business Partners may use information derived from your IP address, such as conducting a reverse domain name lookup, in order to provide advertisements more tailored to your interests.

When We May Disclose Personally Identifiable Information, AppBrick Services, Data or My Address Book and My Phone Book Information

AppBrick works with third parties who provide services to us and we may share Personally Identifiable Information about you with those third parties, including without limitation: Web site hosting or information technology consulting services; Web site management; distribution; mobile alert providers; marketing and promotion services or partners; newsletters; data analysis; legal services; accounting services; fulfilment houses, vendors to process payments and ship orders; and other administrative and back-up and security services.

AppBrick reserves the right to share Personally Identifiable Information about you with its parent, subsidiary or Affiliated Entities ("Affiliated Entities" are those companies owned or controlled by AppBrick's parent company).

In order to provide offers of particular interest to you, AppBrick may share demographic, geographic, and other Personally Identifiable Information with its Business Partners. AppBrick may disclose Personally Identifiable Information about you, the contents of your private communications, or information stored in My Address Book and My Phone Book section if needed to:

(1) comply with applicable laws;
(2) respond to governmental inquiries or requests;
(3) comply with valid legal process;
(4) protect the rights, privacy, safety or property of AppBrick, Site visitors or the public;
(5) permit us to pursue available remedies or limit the damages that we may sustain;
(6) enforce our Terms of Service.

In the event there is a change in the corporate structure of AppBrick, including, without limitation, through merger, consolidation, sale, liquidation or transfer of substantial assets, AppBrick may, in its sole and absolute discretion, transfer, sell or assign information collected on and through the Site, including without limitation, Personally Identifiable Information concerning visitors, to one or more affiliated or unaffiliated third parties.

Security:

This Site uses security measures to protect against the loss or misuse of the Personally Identifiable Information under our control. Although we make good faith efforts to store the information collected by the AppBrick service in a secure operating environment that is not available to the public, we cannot guarantee complete security. If you have reason to believe that your interaction with us is no longer secure, please notify us of the problem by contacting us at AppBrick.Services@AppBrick.com.

Other Web Sites Links:

On the Site, you may have the opportunity to follow a link from or to other Web sites maintained by third parties, including our Business Partners and Affiliated Entities. Because those other Web sites are not hosted or controlled by AppBrick, we are not responsible for the privacy practices of those Web sites. Therefore, the privacy policies with respect to those Web sites may differ from those applicable to the Site and we encourage you to review the privacy policies of each of those other Web sites.

Special Note Concerning Children:

We encourage parents to use the Site with their children. However, this Site is not directed towards children under the age of 13, and we request that children under 13 not provide Personally Identifiable Information to the Site.

Opt-Out/Correct/Delete/Deactivate:

While AppBrick does not give you the opportunity to remove your information from our database, you may remove your registration information from your My Account page as described below. In addition, you may elect not to receive future communications from AppBrick or to discontinue use of our service. You may also opt out of receiving mobile alerts by following the opt-out instructions provided on the Site AppBrick allows its users the option to change information previously provided. This may be done through the following method:

When you provide us with Personally Identifiable Information we may use that information to send you our newsletter or other email communications. At any time, you may change your preferences by: (i) sending us an email (including your email address) at AppBrick.Services@AppBrick.com; (ii) unchecking the box(es) on the My Account Page of the Site related to sending information to you via email; or (iii) using the unsubscribe function in the promotional email. We will update your preferences as soon as reasonably practical. Even if you elect to stop receiving promotional emails from us, we may still contact you to tell you important information about the Site or us.

Also, if you would prefer that we not share Personally Identifiable Information about you with third parties, including Affiliated Entities, for their direct marketing purposes, you may opt out from such disclosures by sending an email address to us at AppBrick.Services@AppBrick.com.

Changes to this Policy:

AppBrick reserves the right to amend this Policy at its sole discretion and any modifications shall be effective immediately upon posting. We will announce any such change by posting the revised draft of this Policy on the Site. You can determine when this Policy was last revised by referring to the "Last Revised On" legend at the top of this page. By continuing to use the Site following such changes, you will be deemed to have agreed to such changes. If you do not agree with the terms of this Policy please do not continue using this Site.
